Breaking News: Florida Files Lawsuit Against California at the Supreme Court on Illegal Drivers

Florida Attorney General James Uthmeier files a Supreme Court lawsuit against California, claiming its laws shielding undocumented immigrants led to a deadly crash by an unqualified trucker.

The Lawsuit and the Tragedy Behind It

On August 12, a tragic crash in St. Lucie County, Florida, claimed three lives—Haitian immigrants legally living in the U.S. The driver, Harjinder Singh, an undocumented Indian national, held commercial driver’s licenses from California and Washington despite failing an English proficiency test. Florida Attorney General James Uthmeier is taking California to the U.S. Supreme Court, invoking the Court’s original jurisdiction under Article III, Section 2 of the Constitution to settle disputes between states. Uthmeier contends that California’s laws, which prevent agencies from checking immigration status for licenses, caused this tragedy and threaten safety nationwide.

This filing marks the first time I know of that a state has invoked the Supreme Court’s original jurisdiction over another state’s immigration-related licensing law.
